Reading Assignment - Class #8

Please read mitzvot #400 – 404.  Please consider the following questions:

 

Mitzvah #400:

1.        At the beginning of the dinei hamitzvah section of this essay the author outlines the order in which various heirs inherit.  Can you list the heirs in order?  Who is missing from this list?

2.      The firstborn son inherits a double portion of the estate as compared to his brothers.

a.      How do we determine who is a father’s firstborn son?  Are any biological sons of a father disqualified?

b.      How is that double portion calculated?

c.       The author says the firstborn son gets a double portion of some estate property but not other estate property.  From which property does the firstborn son get a double share?

3.      Who gets what after the testator dies in the following situations:

a.      The testator says, “My property to you and after you to someone else” and the first beneficiary is an heir.

b.      The testator says, “My property to you and after you to the Temple,” if the beneficiary is an heir.

c.       The testator says, “My property to you and after you to someone else” and the first beneficiary is not an heir.  (Please assume that the beneficiaries in the remaining cases are not heirs.)

d.      The testator says, “My property to you and after you to someone else and after that person to a third person” if the first beneficiary survives the testator and the second beneficiary survives the first beneficiary.

e.      The testator says, “My property to you and after you to someone else and after that person to a third person” if the first beneficiary survives the testator but the second beneficiary does not survive the first beneficiary.

f.        The testator says, “My property to you from now and after you to someone else.”

g.      The testator says, “My property to you and after you to me and my heirs.”
